Win Your Wish List Competition Terms and Conditions

1. BINDING AGREEMENT. BY ENTERING INTO THE PANDORA WIN YOUR WISHLIST COMPETITION (“Competition”) OUTLINED BELOW, YOU ARE ENTERING INTO AN ELECTRONIC CONTRACT WITH SPONSOR TO BE BOUND BY THESE OFFICIAL RULES GOVERNING THE COMPETITION. THEREFORE, PLEASE READ THESE OFFICIAL RULES CAREFULLY BEFORE PROCEEDING. Sponsor encourages you to print and keep a copy of these Official Rules for your records.
2. SPONSOR. The Competition is made available to you by : Pandora Jewelry Pty Ltd ("Sponsor") located at Level 5, 12 Narabang Way, Belrose, NSW 2085, Australia. This competition is in no way sponsored, endorsed or administered by, or associated with, any third party websites the competition is promoted on.
3. DURATION. The Competition begins on 6th November at 08.00 am NZDT, and ends on 16th November 2023 at 11.59 pm NZDT. (“Term”).
4. ELIGIBILITY. Entrants must be existing Pandora Club members or sign up to become Pandora Club members to be eligible to enter. The Competition is subject to all applicable laws and regulations and is void where prohibited or restricted by law. Employees of Sponsor or any of its affiliates, distributors or dealers, its agencies, or members of their immediate families, or persons living in same household, are not eligible to enter or win. Sponsor reserves the right to verify the eligibility of winners.
5. ENTRY. Entries must be submitted online via nz.pandora.net during the term of the competition. To enter, participants must sign up to become a Pandora Club member and add jewellery items to their Wish List during the Term. Existing Pandora Club members can enter by signing in to the website and add jewellery items to their Wish List during the Term. No entries may be submitted on behalf of another person. The use of automatic or robotic entry devices is prohibited. Entries will not be returned or acknowledged. Sponsor reserves the right to verify the authenticity and accuracy of all information provided through the Competition Page.
6. ELECTRONIC COMMUNICATIONS. By submitting your Competition entry via adding jewellery items to your Wish List, you agree to do business with Sponsor electronically. By agreeing to do business electronically, you (i) consent to your personal data being stored on Sponsor’s servers, (ii) consent, subject to Sponsor’s Privacy Policy and Rule 11 below, to the electronic communication and delivery via e-mail and post of all documents related to the Competition, (iii) agree that your act of submitting your Competition entry is a binding form of your electronic signature, which you agree binds you to these Official Rules. This consent is effective unless and until you withdraw it. You may withdraw your consent to electronic communication and delivery of documents or update your contact information at any time by contacting sponsor at [email protected] We will send you a confirmation notice once we have processed your change request.
7. WINNER SELECTION. Although this sweepstakes is referred to as a “Competition” throughout these Rules, the Competition is in fact a game of chance and NOT of skill. There will be one (1) winner in New Zealand at the conclusion of the competition. You will get an entry for participating. The winner selection will occur at 11am on Friday 17th November 2023 at Pandora Australia, Level 5, 12 Narabang Way, Belrose, NSW 2085, Australia. The winner will be chosen using an electronic random entry generator. The winner will receive an email using the email associated with their Pandora Club account. The winner will have to respond to an e-mail from the Sponsor, in order for the Sponsor to receive all the right details, including the winner’s choice of products from their wish list . Failure to respond to prize notification by a potential winner within three (3) months of Sponsor notifying the potential winners by e-mail will result in forfeiture of the applicable prize. Any prize awarded may be forfeited if a prize winner fails to comply with these Official Rules. In the event of prize forfeiture by a prize winner, Sponsor will select an alternative prize winner. If required, a redraw for any unclaimed/forfeited prizes will take place at 11am NZDT on Monday 19th November 2023 at Pandora Australia, Level 5, 12 Narabang Way, Belrose, NSW 2085, Australia. A PRIZE WINNER IS ONLY ENTITLED TO RECEIVE THE PRIZE ONCE HE OR SHE HAS SATISFIED ALL REQUIREMENTS IN THESE OFFICIAL RULES.
8. PRIZES. There will be one (1) prize awarded in New Zealand. The winner will be able to choose current range Pandora jewellery items (subject to availability) from their Wish List up to the value of NZD$1000. The prizes can only be dispatched to a New Zealand address and will be dispatched to the winner within thirty (30) days of the winner responding to the prize notification. Prizes are non-transferable, may not be substituted by the prize winner, and are not redeemable for cash and no cash alternative is offered. Sponsor will not replace any lost or stolen prizes or components of a prize(s). All taxes, fees, duties, surcharges, if any, associated with the redemption of the prize are the responsibility of the prize winner. Sponsor reserves the right to substitute a prize of equal or greater value for any reason.
9. INTELLECTUAL PROPERTY RIGHTS. By submitting his or her entry a participant irrevocably assigns to Sponsor any and all intellectual property rights, including but not limited to any copyright, in any entry submitted by the participant for Sponsor to hold in its own right. Sponsor may use or not use, for any purpose, on any media, in whole or in part, in its original or amended form any entry submitted by the participant. Entrant further agrees that if Sponsor elects to use entrant’s Entry, entrant will execute any documents requested by Sponsor regarding the assignment. By submitting his or her entry a participant also waives his or her moral rights in the entry including the right to be credited as the author and the right to object to derogatory treatment of the work. This waiver is only effective in jurisdictions where it is possible to waive such rights.
10. DISCLAIMERS. Sponsor assumes no responsibility and is not liable for entries that are late, delayed, misdirected, illegible, or incomplete, and Sponsor assumes no responsibility and is not liable for system errors and failures, mechanical equipment malfunctions, viruses, hacker attacks, faulty transmissions, or other telecommunications malfunctions. Proof of transmissions does not constitute proof of entry. By entering the Competition, each participant agrees to be bound by these Official Rules and the decisions of Sponsor.
11. PRIVACY. Sponsor respects your privacy. Personal data of participants is gathered and processed in accordance with the applicable data protection laws, and subject to Pandora’s Privacy Policy, which may be reviewed by visiting https://nz.Pandora.net/en/privacystatement/privacy.html
12. RIGHT TO CANCEL OR TERMINATE. If, for any reason, the Competition is not capable of running as planned, including because of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, corruption, hacker attacks, faulty transmissions, force majeure, or any other cause beyond the control of Sponsor which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Competition. And, in such an instance, Sponsor may, in its sole discretion, decide to award the prizes by random drawing of all eligible entries if it is able to do so fairly. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
13. PERMISSION TO USE NAME/LIKENESS. Any prize winner, by submitting an entry, grants the right and permission to have his or her name, picture and likeness used by Sponsor only for campaign and promotion. Sponsor reserves the right but may choose not to do so.
14. RELEASE OF LIABILITY. Each participant, by entering the Competition, and the winners, by accepting any prize, release Sponsor and Sponsor's affiliates, distributors and dealers, and their agencies, directors, officers, agents and employees from any and all liability, claims or actions of any kind whatsoever for any damage, loss or injury (excluding death or personal injury caused by negligence), any claims based on publicity rights, defamation, invasion of privacy, or merchandise delivery, resulting from or arising out of participation in the Competition, or from the acceptance, use, misuse, possession, loss or misdirection of the prizes. The above parties are not responsible if any prize cannot be awarded due to cancellations, delays, or interruptions due to acts of God, acts of war, natural disasters, weather or terrorism. By entering this Competition, entrant agrees that THE ABOVE PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS OR PROPERTY (EXCLUDING DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE) ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR THE DOWNLOADING FROM AND/OR PRINTING MATERIALS DOWNLOADED FROM SUCH SITE.
15. CONDUCT. By participating, you agree to comply with and be bound by these Official Rules. Failure to comply with these Official Rules may result in disqualification or ineligibility to receive a prize. You further agree to comply with and be bound by decisions of Sponsor, which shall be final in all respects. Sponsor reserves the right at its sole reasonable discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the operation of the Competition and/or the Competition Page; (b) violating these Official Rules; (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
16. DISCLAIMER. THE PRIZES WILL BE AWARDED AS IS AND TO THE FULLEST EXTENT PERMISSIBLE UNDER LAW THE SPONSOR DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE PRIZES. However, nothing in these Rules shall affect your statutory rights including in relation to any Pandora product received as a prize.
17. GOVERNING LAW AND VENUE. The Competition is governed by the laws of New Zealand. Subject to your legal rights as a consumer by entering the Competition participants consent to the jurisdiction and venue of the local court in New Zealand for the resolution of any disputes.
